昆明市城镇房屋装饰改造管理规定
(1995年11月8日 昆政复〔1995〕51号)
第一条 为加强昆明市城镇房屋装饰的改造管理,保证装饰质量,确保房屋的整体稳定性,抗震性和结构安全,促进房屋合理有效利用,根据国家有关政策、法规,结合我市实际,制定本规定。
第二条 凡对城镇原有房屋进行扩建、改造和装饰,均适用本规定。
凡使用和居住于同一幢房屋内的各房屋产权人和使用人,均应遵守本规定。
第三条 本规定所称城镇原有房屋,是指昆明市行政辖区范围内已取得城市房屋所有权证书或纳入城市房屋管理范围,已投入使用的房屋。
第四条 本规定所称的改造和装饰,是指因功能需要和为达到一定环境质量,要改变房屋原设计的结构布置和设施,使用装饰材料对房屋的外表和内部进行改造装饰处理的工程活动,包括拆墙打洞、移门改窗、改造厨房和卫生间,增设隔墙和阳台,影响房屋结构和承载能力的工程装饰及改造。
居民住户在不改变房屋结构、不影响房屋安全的前提下对住房进行面层涂料、贴墙纸、铺贴面砖等简易装饰活动不在本办法管理范围之列。
第五条 昆明市房地产管理局是全市城镇房屋安全管理和装饰、改造的行政主管机关。市房屋安全鉴定机构负责市辖四个区城镇房屋的安全鉴定、装饰改造的安全鉴定管理和审批工作,并对市属八县房屋安全鉴定机构进行业务指导和检查。
第六条 市属八县建设或房地产行政主管部门负责县辖区范围内城镇房屋安全和房屋装饰、改造的管理及审批。
第七条 市、县区建筑工程管理部门及其质检机构,是全市城镇房屋装饰、改造工程及其质量监督管理的机关,按市政府的规定负责对四个区和八县的装饰、改造工程的质量检定进行管理。
第八条 市、县房屋安全鉴定管理部门对城镇房屋进行装饰、改造管理时,按物价管理部门核准的收费标准,收取一定的管理费。房屋安全技术检测鉴定费按国家和省的规定收取。
第九条 房屋装饰、改造应遵守下列规定:
一、不得削弱房屋结构整体稳定性和抗震能力;
二、不得影响房屋结构安全和使用功能,按设计标准、规范文明施工;
三、不得自行变更房屋的主体结构(含基础、柱、墙、梁、板、楼梯和屋面结构)和公共设施(如给排水管道、供电设施、气暖设施等);
四、不得影响相邻住户居住安全和环境,不得损害他人和社会公共利益;
五、严重损坏房屋和局部有险情的房屋,应先修缮加固,达到安全使用,方可装饰;整幢危险房屋,不得再进行装饰;
六、房屋装饰改造,要做到安全适用、经济合理、优化环境,并符合城市规划、消防、供电、环保、给排水、抗震防震等有关规定。
第十条 房屋产权人、使用人,需要进行房屋装饰、改造工程,必须向市、县房屋安全管理部门申请,先进行房屋安全鉴定和批准,然后持房屋安全鉴定书和审批意见,报市、县建筑工程或建设行政管理部门、公安消防、抗震防震管理部门批准,方可实施。
第十一条 房屋使用人装饰改造房屋,必须征得房屋所有权人同意,并签订协议。协议应明确装饰改造范围、修缮、拆迁、补偿等内容。
第十二条 申请房屋装饰改造,应递交以下资料:
一、房屋装饰改造申请书;
二、房屋所有权证和具有法律效力的有关证件(如租赁、协议、证明等);
三、原房屋建筑结构设计、施工图及其有关技术资料;
四、新装饰改造的初步设计议案和施工图;
五、文化娱乐场所营业用房,还应递交营业执照复印件。
第十三条 房屋装饰改造工程,应进行质量和安全监督。装饰改造工程竣工,必须经房屋安全鉴定、质量监督、公安消防、抗震防震等有关管理部门认定合格,方可投入使用。
第十四条 文化娱乐场所营业用房(含歌舞厅、卡拉OK厅、餐饮馆、茶社等)的装饰改造,必须严格遵守防火规范和防火安全管理规定,并实行定期房屋安全年检制度,由市、县房屋安全鉴定和公安消防管理部门实施监督检查。
对已营业不符合房屋安全的,由市、县房屋安全和公安消防管理等部门责令其限期停业整改,经验收合格后,方可营业。
第十五条 房屋产权人或房屋使用人,未按本规定办理审批手续和未经房屋安全鉴定,擅自进行房屋装饰改造工程,按违章装饰改造处罚。管理部门有权责令其停工和修复。
房屋产权人或使用人,因装饰改造,损坏毗连房屋,应负责修复或赔偿。
第十六条 未经批准按规定进行装饰改造,擅自拆改房屋结构,影响房屋正常使用和安全的,由房地产行政主管部门和有关主管部门予以通报批评、罚款、责令停工修复、扣收房屋产权证等处罚。造成房屋安全使用事故的,追究责任人法律责任,触犯刑律的,提请司法机关依法追究刑事责任。
第十七条 房屋安全鉴定单位工作人员,在履行职责中,如滥用职权或玩忽职守,出具的房屋安全使用结论错误,造成房屋安全使用事故或不良后果的,由上级行政主管部门给予行政处分,触犯刑律的,提请司法机关追究刑事责任。
第十八条 本规定由昆明市房地产管理局负责解释并组织实施。
第十九条 本规定自公布之日起施行。

A bill of exchange is an unconditional order in writing, addressed
by

A bill is payable at a determinable future time within the meaning

Definition and requisites of acceptance
The acceptance of a bill is the signification by the drawee of

Time for acceptance
A bill may be accepted--
before it has been signed by the drawer, or while

When a bill payable after sight is dishonoured by non-acceptance,

drawee subsequently accepts it, the holder, in the absence
of any

General and qualified acceptance
An acceptance is either (a) general; or (b) qualified.
A general acceptance assents without qualification to the order
of the
er. A qualified acceptance in express terms varies the effect of

In particular, an acceptance is qualified which is--
conditional, that is to say, which makes payment by the
acceptor

Inchoate instruments
Where a simple signature on a blank paper is delivered by the
signer

e authority to fill it up as a complete bill for any amount, using

manner, when a bill is wanting in any material particular, the

《绍兴市区城市绿线管理办法》已经市政府同意,现印发给你们,请结合实际,认真贯彻执行。

绍兴市区城市绿线管理办法
第一条 为加强城市生态环境建设,创造良好的人居环境,促进城市可持续发展,根据《中华人民共和国城市规划法》、《城市绿化条例》、《城市绿线管理办法》及《浙江省城市绿化管理办法》等有关规定,结合绍兴市区实际,制定本办法。
第二条 本办法所称城市绿线,是指市区各类绿地范围的控制线。
第三条 本办法适用于绍兴市区城市绿线的划定和监督管理。
第四条 市城市规划、园林绿化行政主管部门按照职责分工,负责做好城市绿线的监督和管理工作。
绍兴经济开发区管委会、袍江工业区管委会、镜湖新区管委会负责本区域内城市绿线管理的具体实施工作。
在城市绿线范围内,根据有关法律、法规规定,由林业等行政主管部门管理的绿化工作,依照有关法律、法规的规定执行。
第五条 城市规划、园林绿化等行政主管部门应当密切配合,组织编制城市绿地系统规划。
城市绿地系统规划是城市总体规划的组成部分,应当确定城市绿化目标和布局,规定城市各类绿地的控制原则,按照规定标准确定绿化用地面积,分层次合理布局公共绿地,确定防护绿地、大型公共绿地等的绿线。
第六条 城市规划、园林绿化行政主管部门应当在控制性详细规划中确定不同类型用地的界线、规定绿化率控制指标和绿化用地界线的具体坐标;在修建性详细规划中确定绿地布局,提出绿化配置的原则或者方案,划定绿地界线。
第七条 城市绿线由城市规划、园林绿化行政主管部门根据经法定批准的城市绿地系统规划、控制性详细规划确定,并向社会公布,接受公众监督。任何单位和个人都有保护城市绿地、服从城市绿线管理的义务,对违反城市绿线管理的行为有权进行检举。
因特殊情况,确需调整城市绿线的,由城市规划、园林绿化行政主管部门组织论证,进行公示,按法定程序审批后,方可调整。
第八条 城市绿线范围内的公共绿地、生产绿地、防护绿地、附属绿地和其他绿地等,应当按照城市绿地系统规划、《城市用地分类与规划建设用地标准》和《公园设计规范》等有关标准进行建设。
第九条 居住区绿化、单位绿化及各类建设项目的配套绿化都应达到《城市绿化规划建设指标的规定》的标准。
配套建设绿地应当与主体工程同步设计、同步施工、同步验收。
建设工程竣工后,由城市规划、园林绿化行政主管部门对配套建设绿地的绿线控制情况进行检查。对达不到规定标准的,不得投入使用。
第十条 任何单位和个人不得擅自占用城市绿线范围内的绿化用地或改变其使用性质。
在城市绿线范围内,不符合规划要求的建筑物、构筑物及其他设施应当限期迁出。
第十一条 任何单位和个人不得擅自在城市绿地范围内进行拦河截溪、取土采石、设置垃圾堆场、堆放杂物、排放污水以及其他破坏绿地地形、地貌、水体等生态环境的活动。
第十二条 城市园林绿化行政主管部门应当对城市绿线范围内的绿地进行登记造册,编制规划绿线控制图,并确定现有绿地的绿化管理责任单位。
第十三条 城市规划、园林绿化行政主管部门应当定期对城市绿线的管理情况进行监督检查,对违法行为,及时予以纠正。
第十四条 违反城市绿线管理规定,擅自改变城市绿线内土地用途、占用或者破坏城市绿地、在城市绿地范围内进行拦河截溪、取土采石、设置垃圾堆场、排放污水以及其他对城市生态环境造成破坏活动的,依法予以处罚;构成犯罪的,依法追究刑事责任。
第十五条 违反城市绿线管理规定,在已经划定的城市绿线范围内违法审批建设项目的,对有关责任人员依法给予行政处分;构成犯罪的,依法追究刑事责任。
第十六条 本办法自发布之日起施行。
